1. Agreement to Terms

We reserve the right to modify these Terms at any time. Your continued use of the Platform following any changes constitutes acceptance of those changes. Users under 18 years of age should use this Platform under parental guidance.

2. Nature of Our Content and Services

The Platform provides spiritual and religious content including information about saints, temples, festivals, horoscopes, Panchang (Hindu calendar), audio and video resources, and educational articles.

Horoscopes and Astrological Content: These are provided for educational and entertainment purposes only. We make no claims regarding their accuracy or predictive value, and they should not form the basis for important life decisions.

Health and Wellness Practices: Any content relating to fasting, dietary practices, or physical activities is not medical advice. Users should consult qualified healthcare professionals before undertaking any practices that may affect their health.

Temple and Historical Information: Information about temples, pilgrimage sites, and historical accounts is compiled from various sources. Users should independently verify visiting hours, access rules, and current conditions before traveling.

3. Acceptable Use

Users may access and use the Platform for lawful, personal, and non-commercial purposes. The following activities are strictly prohibited:

• Engaging in any activity that violates applicable laws or infringes upon the rights of others

We reserve the right to suspend or terminate your access to the Platform and your account at any time, for any reason or no reason, with or without notice, on a temporary or permanent basis. Upon termination of your account, your right to access and use the Platform ceases immediately.

11. Disclaimers and Limitation of Liability

Disclaimer of Warranties: The Platform and all content are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We disclaim all warranties including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, reliability, completeness, or non-infringement.

Limitation of Liability: To the maximum extent permitted by applicable law, we shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Platform, including but not limited to:

• Any physical, mental, emotional, or spiritual consequences resulting from following Platform content
• Financial losses resulting from decisions based on horoscopes or astrological guidance
• Incidents occurring during travel to temples or pilgrimage sites
• Business interruption, lost profits, loss of data, or loss of business opportunities
• Technical issues, Platform downtime, bugs, or data loss

Specific Disclaimers: We are not responsible for any misuse, misinterpretation, or unauthorized commercial exploitation of Platform content. Users assume all risks associated with relying upon Platform content for any purpose.

12. Indemnification

You agree to indemnify, defend, and hold harmless Holy India, its affiliates, officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from or related to: (a) your use of the Platform; (b) your violation of these Terms; (c) user-generated content; (d) your infringement of any third-party rights; or (e) any decisions or consequences resulting from your reliance on Platform content.

13. Dispute Resolution and Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles. Any disputes arising from or relating to these Terms or Platform use shall be subject to the exclusive jurisdiction of the courts located in Gurugram, Haryana, India.

Before initiating any legal proceedings, parties agree to first attempt good faith resolution by contacting us and allowing 30 days for resolution attempts. Any claims must be filed within one year of the circumstances giving rise to the claim, or such claims shall be permanently barred.

14. General Provisions

These Terms of Service, together with our Privacy Policy, constitute the entire agreement between you and Holy India regarding Platform use. If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

We may assign or transfer our rights and obligations under these Terms without restriction. Certain provisions of these Terms that by their nature should survive termination shall continue in effect after termination, including intellectual property rights, disclaimers, limitations of liability, and indemnification obligations.
